- It is agreed that CosmeticVacations, LLC., acts as an intermediary between you, the client and/or your family members and/or any other person (as the case may be), and doctors, hospitals, medical service providers, tour operators, accommodation providers and other service providers in Brazil.
- In this regard it is agreed that CosmeticVacations, LLC., its members, agents, employees and representatives do not have any expert skill or knowledge in the field of medical treatment.
- CosmeticVacations, LLC. are not agents, employees, representatives or in partnership with any of the persons or entities to whom you, the client, are referred to or brought in contact with by CosmeticVacations, LLC.
- CosmeticVacations, LLC., its members, agents or employees will not be liable to you the client, your family members or any other person or entity for:
- Any loss or physical injury suffered by you, your family members or any other person or entity arising out of any referral made by CosmeticVacations, LLC.
- Any act, omission or statement by any doctors, hospitals, medical service providers, tour operators, accommodation providers and other service providers in Brazil.
- Any act, omission or statement by CosmeticVacations, LLC. in the course of their duties.
- You, the client, hereby indemnify and hold harmless CosmeticVacations, LLC. against any of the aforesaid loss and physical injury which may be suffered by you, your family members or any other person, which indemnity shall include indemnity for legal costs incurred by CosmeticVacations, LLC. in defending any action instituted against CosmeticVacations, LLC. arising out of the aforesaid, on an attorney and client scale.
- In addition to the above, you, the client, hereby irrevocably waive all your rights to any cause of action which you may now or in the future have against CosmeticVacations, LLC.
- Any term of this agreement which is or is held to be invalid or unenforceable for any reason whatsoever shall not affect the validity or enforceability of the remaining provisions of this agreement and shall be deemed to be severed from this agreement.
- The laws of Brazil govern the application and interpretation of this agreement.
